Martha Stewart's company and daughter infringed upon the trademark of a California cable television program, "Whatever," with their own show of the same name on satellite radio, a lawsuit alleged Wednesday.
The lawsuit, in U.S. District Court in Manhattan, was filed by Hilda Kunstadt, an self proclaimed artist and media personality who produces a cable TV interview series in Oxnard, Calif.
Kunstadt, 78, accused Alexis Stewart of ripping off her idea when Stewart and Martha Stewart Living Omnimedia Inc. last fall began producing a talk show for Sirius Satellite Radio Inc. called "Whatever."
In a letter sent to Kunstadt last week, Martha Stewart Living Omnimedia lawyer Heather Greenberg rejected Kunstadt's claims.
"As I stated to you earlier ... during our phone conversation, we believe your claims are baseless and that we have the right to use this mark in connection with our radio program," Greenberg wrote.
